「美國獨立宣言」實質是求救宣言?

雖然實際上「真獨立日」在 7 月 2 日已凜然誕生,當日北美十三州殖民地代表舉行的「大陸議會」(Continental Congress)於 1776 年 7 月 2 日已通過脫離英國統治動議;但 7 月 4 日現為美國獨立日,按「獨立宣言」的通過日期慶祝美國獨立。

一般人把「獨立宣言」簡化成:在美洲的殖民者不能再忍受英國政府不公義的法律和沒有議會代表下的苛稅,因此代表他們的大陸議會,通過撰寫宣言,解釋獨立和革命的原因。不過軍事歷史學者、美國喬治梅森大學講師 Larrie D. Ferreiro,對此簡化觀點不以為然,日前於文化雜誌 Smithsonian 撰文闡述美國獨立宣言的本質,其實是向法國和西班牙求救的宣言。

Ferreiro 先指出,在列星頓和康科德戰役(Battles of Lexington and Concord)爆發後,美國殖民者基本相信美國無可避免要脫離英國統治。但從當時情況來看,美國殖民地與大英帝國的實力懸殊,美國殖民地沒有海軍,只有零星火炮和火藥,以及臨時組織的民兵。美國政治家 Benjamin Franklin 於 1775 年邦克山戰役後自嘲道:「世界在好奇為何我們很少發射大炮,事實上我們根本負擔不起。」美國要勝出戰爭,必須爭取盟友。

在 1763 年結束的「七年戰爭」中,法國失去了加拿大及自身在歐洲的中心地位,西班牙則放棄了佛羅里達州及其在墨西哥灣的統治地位。可是,即使法國與西班牙早已對強橫的英國咬牙切齒,也不會貿然介入英國的內戰。「獨立宣言」主要起草人 Thomas Jefferson 心裡清楚,美國必須表明是一個獨立國家,才能與其他國家共同對抗英國。

7 月 4 日,當日為星期四,大陸議會通過了「獨立宣言」,翌日便印製好數百份印刷本。直到星期一,議會把複本以快船送往法國,在巴黎的特使則命令把文件從速送到法國法院及西班牙法院。Ferreiro 稱,該文件雖然叫作「獨立宣言」(Declaration of Independence),同時也是對法國及西班牙的「依靠」(dependence)宣言。

Ferreiro 對獨立宣言的解讀是,宣言不是對英國說的,因為早在 1775 年,英王喬治三世和英國議會已認定美國的叛亂,是為了脫離帝國統治;宣言也不是對美國殖民者說的,因為各州代表早已受到指示支持美國獨立。結果前所未有以正式文件宣告獨立的「獨立宣言」誕生了。

美國政治理論家 Thomas Paine 在其著作極具影響力的暢銷書「常識」(Common Sense),激勵殖民地人民獨立,書中亦揭示了書面的獨立宣言與潛在的軍事聯盟之間的關係,其中寫道:「所有法院的慣例都是反對我們的,將來也會如此,直至獨立——與其他國家平起平坐。」在「常識」出版了數星期後,殖民地領袖 Richard Henry Lee 與 Samuel Adams 相繼響應號召,麻省的代表 John Adams 本來亦擔心外交糾纏,也承認「現實是我們必須宣佈獨立,並且向法國和西班牙提交條約……我們需要火炮、武器、彈藥、衣服」。

1776 年 6 月 7 日,Richard Henry Lee 在大陸會議中動議美國殖民者應採取「最有效的方式來結成外國聯盟」。在辯論完可行措施後,議會成立了一個小型委員會來草擬宣言,由 Thomas Jefferson 擔任作者。Jefferson 在極有限的時間和方向中,以其橫溢的天才把一份危急文件,撰寫成啟蒙思想的宣言,基於自由、平等和權利來爭取獨立。

「獨立宣言」誕生一年之內,法國就與美國簽署條約,自動參戰;一年後,即使沒有正式與美國結盟,西班牙也協助法國參與戰事。他們把地區戰爭擴戰成世界戰爭,幫助美國擺脫英國統治,結果西班牙從英國人手上重奪了佛羅里達州,而法國則和美國在約克鎮並肩作戰,戰勝英國。Ferreiro 結論稱,若沒有西法兩國的潛在國際盟友,美國最重要的獨立宣言也許不會面世。獨立宣言的真正「初衷」還待歷史學家辯論,但背後說明的道理卻很淺白:獨立講求實力,實力不足便要尋求盟友。

人人底線同成本都唔同,只係希望你起碼都有自己既底線。

我自己既大原則係盡可能唔買 made in China,底線就係盡量避免中國公司中國牌子。

同一間公司既同一類產品,made in China 同 not made in China 如價錢相差唔遠,就盡可能買 not made in China。

屋企上網 HKT 最快最穩,知佢用 huawei 咁我無得揀,就無得揀囉。

Mobile network 用開 CSL最近先留意係 huawei,又原來 smartone 用 ericsson,咁就盡快轉去 smartone 囉。

避就避唔晒,盡可能,就係咁姐。

35 名前政府官員及社會人士以個人名義聯署,促請政府以實際行動化解當前社會日深的矛盾,不把前線警務人員推向政見對立的前緣,並要就事件成立法定獨立調查委員會。又呼籲警方管理層在制定應變指揮策略時,以社會利益為依歸。聯署人包括經濟學者林本利、社聯前行政總裁方敏生,中大前任校長沈祖堯、商人王維基、香港總商會總裁,王維基妻子袁莎妮、香港大學醫學院微生物學講座教授袁國勇、運輸及房屋局前副局長邱誠武、前財政司司長政治助理羅永聰、袁天佑牧師、香港知名宗教界及醫學界人士蔡元雲等。

《逃犯條例》修訂自六月起引發連串大型公眾遊行和抗議行動,由於特區政府的回應和民眾訴求之間存在落差,接連的和平遊行或請願常演變成警民衝突,暴力在惡性升級,警民關係超越臨界線,危險境況已在滑坡邊上,大眾憂心忡忡。

我們是一群熱愛香港、長期參與香港發展,並以此地為家的香港人。眼見事態惡化,有感降溫之逼切,否則後果不堪設想。我們懇切呼籲各方當下必須克制,放下敵意,甚或暴力抗爭,再謀求走出困局之路。我們呼籲:

行政長官及特區政府

展現作為特區領袖的政治道德勇氣,從香港社會整體利益出發,以實際行動化解當前社會日深的矛盾;
政治問題始終要政治解決,不把前線警務人員推向政見對立的前緣;
政府帶動和解,成立法定獨立調查委員會,以較宏觀視野和範圍調查過去一個多月的衝突由來和過程。調查旨在尋找真相,並非針對任何一方,並在共同認識的真相基礎上,吸收經驗和教訓,走向和解,修補各方關係。調查過程期間,社會矛盾亦可開始緩和。倡議獨立調查委員會之框架,社會輿論趨向共識,我們懇請行政長官和特區政府再三考慮。
示威人士

我們理解眾多請願和示威人士目前的不滿和失望。
市民和平、理性及非暴力表達意見的權利,是必須受到尊重和保護。
我們懇請示威或請願人士縱有多大不滿,亦不要以危害人身及生命方式進行。社會議題的爭取總有其過程,能持續凝聚大多數人的支持才是成功關鍵。暴力每每帶來仇恨,不單分化社群,亦誘發更多暴力,使人偏離初心,主動或被動的流血、失去自由、甚至犧牲。
警務人員

我們感受警務人員的工作壓力和面臨的挑戰。
警務管理層在制定應變指揮策略時,應以社會利益為依歸,尤其是在處理突發衝突,盡力避免矛盾進一步升級,並考慮對大多數市民的影響、無辜市民和示威者的反應,以及前線警務人員的安全。
警務人員務必以專業紀律執行職務,維持警隊在市民心目中應有的良好形象。
新聞自由

新聞自由是香港的核心價值之一,我們呼籲各方必須尊重和保護。
香港是我們珍視的家,近月來的事態發展,迫使我們直面社會何去何從的問題。警民本無辜,在這危急時刻,我們冀望行政長官和特區政府展現領導風範,以政治手段解決政治問題,儘速設立獨立調查委員會 。此乃減免武力衝突以至紓解社會危機之關鍵所在;各方務必克制,免讓仇恨蔓延 ,撕裂加深, 給香港重新出發的機會。

WASHINGTON (Reuters) - U.S. President Donald Trump said on Monday he believed Chinese President Xi Jinping has acted “very responsibly” with the protests in Hong Kong over an extradition bill that could see people from the territory sent to China for trial.

“We’re working on trade deals right now. We’ll see what happens,” Trump told reporters at the White House before an unrelated meeting with Pakistani Prime Minister Imran Khan.

Hong Kong has been hit by a series of sometimes violent protests for over two months - its most serious crisis since the city was handed back to China by Britain in 1997 but with democratic freedoms under a “one country, two systems” formula.

“I know that that’s a very important situation for President Xi,” Trump said, adding that “China could stop them if they wanted.”

“I think that President Xi of China has acted responsibly, very responsibly.” Trump told reporters. “I hope that President Xi will do the right thing.”

The U.S. Should Defend Hong Kong

America’s recently departed envoy warns that Beijing poses a dire threat to the city’s cherished freedoms.

When I left my post as U.S. Consul General in Hong Kong recently, news organizations reported that the White House had effectively censored my valedictory remarks, as President Donald Trump apparently did not want to disrupt trade negotiations with Chinese leader Xi Jinping. The Washington Post went so far as to say I’d been “neutered.”

Put the short-term politics aside. What matters is figuring out what’s really driving Hong Kong’s current unrest, and what the governments of Hong Kong, China and the U.S. should do about it.

The U.S. has more at stake here than many Americans realize. Opening doors to free and fair trade, with China and other partners, has been a consistent core interest of the U.S. in the western Pacific. Hong Kong has been at the center of that effort ever since the U.S. first opened its consulate in the city 175 years ago.

Today, Hong Kong deserves America’s commercial, financial and strategic respect and support because its economy and society are positive models for all of Asia. The city shows how open markets and transparent governance work together to create prosperity. The city’s value is buttressed by its rule of law -- not just rule by law -- and by its independent judiciary and sense of fair play.

That’s why more U.S. businesses -- close to 1,400 of them -- now operate in Hong Kong than when the British returned their onetime colony to China in 1997. Many important American firms, especially in finance and services, continue to favor the city for their Asian headquarters.

Hong Kong’s high degree of autonomy is the necessary ingredient for this success. China’s growing encroachments on that autonomy, however, pose a very real threat to the city’s special status and future competitiveness.

During my three years as U.S. Consul, I saw Beijing’s interference take many forms: the disqualification of electoral candidates based on their political views; the banning of political organizations; and the prosecution of political activists for encouraging others to peacefully block traffic five years ago.

This year was marked by the Hong Kong government’s dramatic miscalculation to rush through legislation allowing extraditions for trial in mainland China’s unfair courts. A record number of citizens took to the streets in opposition; protests have continued even after Hong Kong Chief Executive Carrie Lam declared the legislation effectively “dead.”

This outcry is proof that leaders in Beijing have thoroughly underestimated the social anxiety and tensions inherent in the “one country, two systems” construct -- exacerbated of course by glaring economic inequalities within Hong Kong society. A more accurate formulation might be “same bed, different dreams.”

That reality requires much more careful handling. Most important, Beijing needs to not fret so much about Hong Kong and its freedoms of expression. It should be confident in the city’s future and its positive role inside China.

Let’s be serious: No outside power wants to see a “color revolution” in Hong Kong. Foreign investors hope only to preserve the status quo -- a Hong Kong that is stable, rules-based, transparent and open; one that is part of China but a uniquely easy place to do business.

The bigger problem is how the incentives for China to interfere in Hong Kong are becoming institutionalized. The Chinese governmental organizations handling Hong Kong affairs are now so large that they have good bureaucratic reasons to eschew the “less is more” approach that the situation requires. Chinese leaders need to realize they could destroy Hong Kong’s economic specialness if they keep trying to align its political culture with mainland norms.

Hong Kong’s city leaders, on the other hand, need to stay in closer touch with their people’s aspirations. Autonomy is a “use it or lose it” proposition. They must firmly embrace the notion that Hong Kong’s dual identity is an opportunity, not a burden, and convey that message to Beijing.

Hong Kong is both the most prosperous city in the world’s largest nation and a place with its own cosmopolitan identity and a degree of interconnectedness with the globe that is unique in Asia. Its leaders should double down on being “Asia’s World City.” Commitment to this idea faded in recent years, as Hong Kong leaders devoted energy to echoing mainland priorities.

A renewed international push should include more outreach to the U.S., which is, after all, Hong Kong’s most important economic and cultural partner outside China. And the U.S. should reciprocate. In my final message home to Washington, I urged colleagues to recognize the city’s abiding strengths. After all, a couple million people validated last month that Hong Kong remains very different from mainland China.

Most important, U.S. leaders should always remember that the city isn’t a card to be played against Beijing -- neither a means of highlighting flaws in the mainland’s governance when it suits us, nor a token to be exchanged for concessions in trade talks. Rather, Hong Kong is a vision of what we should want China, and indeed much of the rest of Asia, to look like. We should seek ways to bolster its strengths.

中國國務院新聞辦公室今早發表《新時代的中國國防》白皮書,其間國防部新聞發言人吳謙被問及香港近日示威情况,他表示對於周日香港示威者衝擊中聯辦一事「不能容忍」,至於國防部會如何處理香港目前形勢,吳謙沒正面回應,僅稱「在駐軍法的第3章第14條有明確規定」,暗示必要時解放軍可派兵協助維持香港治安。

吳謙在記者會上表示,這段時間他們密切關注香港形勢發展,「特別是7月21日的遊行及暴力事件,以及激進分子衝擊中聯辦。對此,港澳辦已經作出回應,部分激進示威者的行為挑戰中央政府權威,觸碰『一國兩制』的原則底線,是絕對不能容忍的,『東方之珠』不容玷污」。對於有香港記者問及中國國防部如何處理港獨勢頭,吳謙說:「在駐軍法的第3章第14條有明確規定。」  

根據《中華人民共和國香港特別行政區駐軍法》第3章第14條規定,「香港特別行政區在必要時,可以向中央人民政府請求香港駐軍協助維持社會治安和救助災害。香港特別行政區政府的請求經中央人民政府批准後,香港駐軍根據中央軍事委員會的命令派出部隊執行協助維持社會治安和救助災害的任務,任務完成後即返回駐地」。

(Washington)—U.S. Representative James McGovern (D-MA) and U.S. Senator Marco Rubio (R-FL), the Chair and Cochair respectively of the bipartisan and bicameral Congressional-Executive Commission on China (CECC) today issued a joint statement urging the Administration to condemn the threat to deploy the People’s Liberation Army in Hong Kong.

“Threats of intervention by the People’s Liberation Army (PLA) in Hong Kong are unacceptable and needlessly escalate tensions. Escalation of violence – whether on the part of organized crime thugs or the PLA – will only further undermine Hong Kong’s autonomy and rule of law. Instead, the Hong Kong government should listen to the legitimate grievances of Hong Kongers and enter into substantive discussions. Consistent with the U.S.-Hong Kong Policy Act, we stand with those in Hong Kong who are peacefully promoting democratic principles and the rule of law – rights guaranteed to them both by the Chinese government and their own. The Trump Administration should strongly and publicly condemn any threats to Hong Kong citizens and U.S. residents of Hong Kong. We also ask the Hong Kong government to condemn the Chinese government’s threats as unwelcome interference in Hong Kong’s affairs.”

Background: Today, Colonel Wu Qian of the People’s Liberation Army (PLA), a propaganda officer, warned that China is ready to act and hinted that PLA forces may be used to intervene in Hong Kong. On June 13, CECC Commissioners introduced that Hong Kong Human Rights and Democracy Act in the U.S. Congress.

Washington—Representative Eliot L. Engel, Chairman of the House Committee on Foreign Affairs, today made the following statement on the situation in Hong Kong:

“I am deeply concerned by the reports of police brutality in response to peaceful protests in Hong Kong and by the vigilante attacks on reporters in Yuen Long MTR Station. I urge all parties to exercise restraint and call on the Hong Kong Government to uphold its commitment to the rule of law. Allegations of police violence over the past weeks have tarnished Hong Kong’s international reputation for good governance and the fair administration of justice.

“Moreover, Beijing’s increasingly harsh responses and propagandic depictions of ‘radical protestors’ as ungrateful troublemakers egged on by ‘foreign interference’ further sheds light on the Chinese Communist Party’s continued attempts to chip away at the freedoms and rights that make Hong Kong unique.

“These protests originated as a response to the problematic amendments proposed to Hong Kong’s extradition law, but the sustained discontent is a clear reflection of a broader disconnect between the Hong Kong Government and the aspirations of its people. I hope the Chief Executive will take all steps to address these issues head-on.”

美國總統特朗普昨(26日)警告,若世界貿易組織(WTO)未來90日內,不能取得重大改革,將不再承認中國及其他相對富裕的國家在世貿中,享有「發展中國家或經濟體」地位,認為世貿依賴過時的二分法,令有些聲稱發展中國家在貿易上享有不對等的待遇和優勢。

特朗普在備忘中指出,若世貿未能在90日內於改革路上取得實際進展,將指示貿易代表萊特希澤停止對一些發展中國家給予特別待遇。他表示,美國從來不接受中國聲稱為發展中國家,又點名提到包括香港、澳門、新加坡、韓國、卡塔爾及土耳其等國家和地區,批評它們不恰當地自稱為發展中經濟體,從而在貿易中獲得不公平的優勢。他認為不能再讓它們避過世貿的規例獲得特別待遇,對遵從遊戲規則的美國不公。

對於特朗普要求世貿改革,停止讓中港澳等稱為發展中經濟體,香港商務及經濟發展局局長邱騰華表示,香港是全世界最開放的地方,若說香港要求取得優惠,說法與事實不符。

(二) WTO 之決策程序
1. WTO之決策沿續過去之作法,儘量避免票決,而係依共識決作成決策。共識決之優點在於會員較易為了多邊貿易體系之整體利益而形成共識;但由於各會員仍有機會表達其立場,並進行辯論,是故共識決之程序亦可使個別會員之利益受到適當考量。如果就特定案件無法達成共識時,則WTO設立協定亦有票決之規定,票決係依一會員一票之原則,以多數決達成決議。

2. 依據WTO設立協定之規定,有下列四種情形須進行票決:
(1) 任何多邊協定之解釋案,應以四分之三之多數決通過。
(2) 有關豁免特定會員在多邊協定下之特定義務之決議,應以四分之三之多數決通過。
(3) (多邊協定條文之修正案,應視各該條文之性質採一致決,三分之二多數
決,或四分之三多數決;惟其修正內容如改變會員之權利義務則僅對接受修正案之會員生效。
(4) 新會員之加入,須在部長會議中經三分之二多數決通過。關於此節,WTO總理事會於1996年10月的一項會議中決議,對於新會員之入會審查案,將採共識決之方式。此後,對新會員之入會審查,已改為以共識決為原則,但原條文有關三分之二多數決之規定仍然有效。

White House Eyeing Chinese Forces Gathered on Hong Kong Border

The White House is monitoring what a senior administration official called a congregation of Chinese forces on Hong Kong’s border.

Weeks of unrest in the Chinese territory have begun to overwhelm Hong Kong’s police, who have found themselves in violent clashes with protesters. China warned Monday that the civil disorder had gone “far beyond” peaceful protest after police deployed tear gas over the weekend.

The nature of the Chinese buildup wasn’t clear; the official said that units of the Chinese military or armed police had gathered at the border with Hong Kong. The official briefed reporters on condition he not be identified.

The mainland government said Tuesday that violence in Hong Kong was a “creation of the U.S.,” a charge the administration official denied.

The developments come as President Donald Trump seeks a trade deal with China and just as the two nations resumed negotiations in Shanghai. Trump has spoken only sparingly about the protests, praising Chinese President Xi Jinping for his restraint. But it’s unclear how much planning the U.S. has done to prepare for possible Chinese military intervention in Hong Kong.

U.S. Secretary of State Michael Pompeo urged the Chinese on Monday to “do the right thing” in managing the protests in Hong Kong, which began more than eight weeks ago, after the city-state’s executive, Carrie Lam, tried to win passage of a law allowing extraditions to the mainland.

Chinese Foreign Ministry spokeswoman Hua Chunying responded to Pompeo on Tuesday by blaming the U.S. for the protests.

“It’s clear that Mr. Pompeo has put himself in the wrong position and still regards himself as the head of the CIA,” Hua said, referring to Pompeo’s previous role at the intelligence agency. “He might think that violent activities in Hong Kong are reasonable because after all, this is the creation of the U.S.”

Pompeo, heading to a regional conference in Bangkok on Tuesday, responded mildly when asked by a reporter on his plane what he’d say to the Chinese foreign minister when they met at the event.

“With respect to Hong Kong, this is the people of Hong Kong asking their government to listen to them,” he said. “So it’s always appropriate for every government to listen to their people.”

Paul Sullivan, an international security expert at the National Defense University, said that China views the situation in terms of its long-term impact on the regime’s central power.

“The Chinese most likely have a very long-term perspective on this, and they aren’t going to be one China and two systems anymore,” Sullivan said. “My sense is that they want to completely chew up Hong Kong and make it part of the central part of China, maybe to improve their trading and economic base.”

Charles Lipson, a political science professor at the University of Chicago, said the U.S.’s options to intervene would be limited.

“There’s very little the U.S. can do, should do, or will want to do prior to a major crackdown,” Lipson said. “After which the U.S. will complain mightily but from the point of view of the U.S., there’s essentially nothing that can be done if the Chinese want to crack down on Hong Kong.”

北韓官方《勞動新聞》日前評論香港問題,強調支持中國黨和政府解決香港事態的措施,評論表示,不論是誰,應該尊重中國的主權,停止以任何方式干涉香港事務。

在北京,外交部發言人華春瑩讚賞北韓在香港問題上發出正義的聲音,強調香港是中國的香港,堅決反對外部勢力企圖插手干預,中方有決心和能力,維護好香港的和平和穩定,強調在世界上,最終邪是壓不了正。

另外,對於台灣的陸委會亦有回應香港的事態,認為香港抗爭不斷是源自港人對北京及政府管治的恐懼與失望。華春瑩表示,唯有和平統一以及一國兩制,台灣的明天才會更美好。

中美第12輪貿易談判破裂 提早結束離開上海

第十二輪中美貿易磋商在上海提前結束。根據彭博社等報導,中美貿易團隊於下午1時37分左右在上海拍照留念並握手。美國官員沒有發表任何公開言論,立即驅車前往機場,離開上海。

報導指出,根據之前的時間表,攝影中美最初安排在下午2時15分左右才結束。暫時未有任何一位官員發表公開言論。美國官員隨後立即啟程前往機場。

中美代表今早在上海舉行第二日高級別貿易磋商。大陸副總理劉鶴與美國貿易代表賴海哲(Robert Lighthizer),以及財長米努勤(Steven Mnuchin)會前先握手和合照,雙方再開始正式會談。

外界早前預期,雙方不會作出重大原則性讓步,預計此次貿易磋商不會取得重大突破。
